Terms of Service
Welcome to Lava (hereinafter referred to as “the Service” or “Lava”), operated by Lava Intelligence Co., Ltd. (“the Company”). By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and related policies, including the Privacy Policy.
1. Eligibility
By using the Service, you confirm and represent that:
- You are at least 18 years old and have full legal capacity to enter into contracts under applicable law.
- You have never been convicted of a serious criminal offense such as violence, sexual assault, or fraud, and are not listed on any sex offender registry.
- You agree to comply with all applicable laws and these Terms throughout your use of the Service.
2. Account Registration and Security
- To use Lava, you must register an account and provide required information (e.g., phone number, email address).
- You agree to provide accurate, complete, and up-to-date registration information, and to maintain its accuracy.
- You are responsible for maintaining the confidentiality of your login credentials. If your account is compromised, please contact us immediately (Email: service@lava.tw).
- You may not transfer, lease, or share your account with others.
3. Service Description
Lava provides the following features and services, including but not limited to:
- Creating and viewing personal profiles
- Swipe-based matching and chat interaction
- Question-based and psychological testing features
- Offline date scheduling, calendar integration, and check-in records
- Recommendations for bars and events
- Optional paid features and virtual items (e.g., event tickets, premium interactions)
The Company may adjust, add, or remove features at any time without prior notice. Significant changes will be announced on the platform.
4. User Conduct and Prohibited Activities
Users shall not engage in any of the following while using the Service:
- Posting or transmitting false, obscene, discriminatory, violent, hateful, fraudulent, illegal, or rights-infringing content.
- Collecting personal data of other users without consent; engaging in harassment or stalking.
- Impersonating others or submitting false information to commit identity fraud.
- Publishing others’ photos, personal data, conversations, or sensitive information without consent.
- Using automation tools or plugins to manipulate accounts or disrupt the Service.
- Engaging in behavior that seriously violates public order or good morals.
If a violation is found, the Company may, depending on the severity, take one or more of the following actions:
- Issue a warning
- Restrict or suspend specific features
- Suspend or permanently delete the account
- Cooperate with legal authorities and submit relevant information
5. Offline Interaction and Risk Disclaimer
Lava encourages safe and respectful offline interaction but cannot control or guarantee users’ behavior during in-person meetings.
- You are responsible for evaluating the risks of meeting strangers and should take precautions (e.g., meeting in public places, informing a friend).
- If you encounter inappropriate or dangerous behavior, contact the police immediately and report the incident to Lava.
The Company is not liable for any personal, financial, or emotional harm arising from offline interactions unless caused by gross negligence on the platform’s part.
6. Content Responsibility and Licensing
- You are solely responsible for any content you upload or publish via the Service (including text, images, and videos) and warrant that it does not infringe third-party rights.
- You grant the Company a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, store, modify, and reproduce such content for purposes related to operating, marketing, or improving the Service.
- The Company reserves the right to remove, block, or disable any content that violates these Terms without prior notice.
7. Paid Features and Virtual Items
- Lava offers optional paid features and virtual items (e.g., priority visibility, event tickets, visual effects) that users may purchase at their discretion.
- All virtual items are for use within Lava only, non-transferable, and not redeemable for cash.
- Except where required by law, all completed transactions are non-refundable.
8. Platform Updates and Service Interruptions
- The Company may conduct routine maintenance, updates, or feature adjustments, which may cause temporary service interruptions.
- The Company is not liable for any disruptions or errors caused by:
- System or network equipment failures
- Third-party service disruptions (e.g., cloud hosting, payment providers, login APIs)
- Force majeure events such as natural disasters or cyberattacks
9. Third-Party Links and External Services
The Service may include links to third-party websites or services (e.g., bar listings, reservation platforms, Line login). Any interactions or transactions with such third parties are governed by their own terms. The Company assumes no responsibility for such relationships.
10. Intellectual Property
- Except for user-submitted content, all designs, trademarks, graphics, text, software, and databases on the Service are owned by the Company or its licensors and protected by applicable intellectual property laws.
- You may not copy, modify, distribute, reverse engineer, or otherwise exploit any part of the Service without prior authorization.
11. Limitation of Liability and Indemnity
- To the extent permitted by law, the Company is not liable for any direct, indirect, incidental, punitive, or consequential damages arising from use or inability to use the Service.
- If your violation of these Terms or unlawful conduct causes harm to the Company or others, you are fully responsible for compensation, including reasonable legal and litigation-related fees.
12. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Republic of China (Taiwan).
- In the event of a dispute, both parties agree to submit to the exclusive jurisdiction of the Taipei District Court, Taiwan, for the first instance.
- The Company reserves the right, within the bounds of applicable law, to decline participation in class-action lawsuits.
13. Amendments to the Terms
The Company may revise these Terms at any time and will post updated versions via the Lava App or official website. For major changes, at least 7 days’ advance notice will be given before the changes take effect. Continued use of the Service after such notice constitutes acceptance of the revised Terms.
